Children (under 14 years) who are convicted of a DUI even as a passenger have to undergo a month’s imprisonment.
 First Conviction:
  • Imprisonment - 48 hours of mandatory imprisonment

  • Fine - $500 to $1,000 plus court costs, probation and evaluation fees.

  • Mandatory - 30-day license suspension, DUI school attendance.

  • Vehicle may be seized - Up to a year.

  • In addition to the all mentioned above the driver should complete alcohol and drug safety action education program and/or treatment program.
 Second Conviction:
  • Imprisonment - 90 days to one year imprisonment, or not less than 20 days community service

  • Fine - $1,000 to $1,500 plus court costs, probation and evaluation fees.

  • Mandatory - Court ordered treatment program for alcohol and drug abuse

  • Vehicle may be seized - Up to a year.

  • Driving privileges - Suspension for One year. After a year of suspension an ignition interlock will be equipped in your vehicle which will not allow starting your vehicle when you are intoxicated.
 Third Conviction :
  • Imprisonment - 90 days to one year imprisonment and will be charged with a felony offense

  • Mandatory - Must complete the court ordered treatment program for alcohol and drug abuse

  • Fine - $1,500 to $2,500 plus court costs, probation and evaluation fees

  • Vehicle may be seized - Up to a year.

  • Driving privileges - Suspension for One year. After a year of suspension an ignition interlock will be equipped in your vehicle which will not allow starting your vehicle when you are intoxicated.
 Fourth or Subsequent Conviction:
  • Imprisonment - 90 days to one year imprisonment and will be charged with a felony offense

  • Mandatory - Must complete the court ordered treatment program for alcohol and drug abuse

  • Fine - $2,500 plus court costs, probation and evaluation fees

  • Vehicle may be seized - Up to a year.

  • Driving privileges - Suspension for One year. After a year of suspension an ignition interlock will be equipped in your vehicle which will not allow starting your vehicle when you are intoxicated.
 Fifth or Subsequent Conviction:
  • Imprisonment - 90 days to one year imprisonment and will be charged with a felony offense

  • Fine - $2,500 plus court costs, probation and evaluation fees

  • Driving privileges - Permanently revoked.
